Explanation of sexual offences and prostitution

Sexual offences are defined as excessive and improper sexual conduct. This includes behaviour that has nothing to do with prostitution and that does not involve money changing hands. So the concept of sexual offences is broader than prostitution. The courts have ruled that ads for partner swapping are covered by the term sexual offence. When the term sexual offence is used on its own it always includes prostitution. (Y MUYTINCK and E VAN ACKER, l.c., 136-138)
